Refund and Cancellation Policy

I. This Refund and Cancellation Policy applies to ListWithEase, operating through ListWithEase.ca, and explains the rules relating to payments, cancellations, refunds, upfront package fees, third-party service fees, and deferred sale-completion fees. For questions regarding this policy, you may contact us at support@ListWithEase.ca.

II. ListWithEase provides flat-fee MLS® listing and related real estate marketing services for homeowners. This Refund and Cancellation Policy should be read together with your selected package terms and any signed service, customer, or representation agreement. If there is a conflict between this policy, applicable law, and a signed agreement, applicable law will apply first and the signed agreement will govern the matters it specifically addresses.

III. Your selected package may require an upfront package fee plus applicable GST to reserve your listing service and begin the setup and preparation process.

IV. The upfront package fee may cover consultation, listing preparation, review of property information, MLS® entry preparation, administrative support, marketing coordination, reserved service capacity, setup work, and other services specifically included in your selected package.

V. The upfront package fee is non-refundable once payment has been processed, except where a refund is required by applicable law or is expressly provided for in your signed agreement or another written policy that applies to your service.

VI. The upfront package fee remains non-refundable if you later decide not to list your property, change your mind, no longer wish to sell, postpone the sale, sell the property privately, withdraw the property, suspend the listing, allow the listing to expire, or otherwise choose not to proceed after payment has been processed or work has begun, subject to applicable law.

VII. The upfront package fee will not be refunded if you decide to use another REALTOR®, real estate professional, traditional full-service brokerage, flat-fee brokerage, private-sale service, marketing company, or another method of selling or marketing the property after purchasing a ListWithEase package.

VIII. The upfront package fee will not be refunded if you decide to terminate, withdraw, suspend, postpone, or discontinue ListWithEase services because another brokerage, real estate professional, buyer, investor, family member, business, or other person offers or recommends an alternative method of selling the property.

IX. The upfront package fee will not be refunded because you obtain a private buyer, decide to sell the property privately, enter into a transaction outside the ListWithEase marketing process, decide not to place the property on MLS® or REALTOR.ca®, or otherwise change your preferred selling strategy after payment has been processed.

X. The upfront package fee will not be refunded because you change your asking price, expected sale price, preferred possession date, marketing strategy, listing timeline, property plans, financial circumstances, or expectations regarding the sale.

XI. The upfront package fee will not be refunded solely because you are dissatisfied with market conditions, buyer interest, showing activity, inquiries, offers, anticipated sale proceeds, competing properties, estimated selling time, or other market-related circumstances.

XII. Some packages may include a deferred sale-completion fee. This is the remaining portion of the applicable package fee that becomes payable only when the property sale successfully closes, subject to the terms of your signed agreement.

XIII. Where a deferred sale-completion fee applies, you pay the required upfront package fee to begin the service and the remaining sale-completion fee becomes payable after the successful closing of the property sale as set out in your signed agreement.

XIV. If the property does not sell and no transaction successfully closes, no deferred sale-completion fee will be charged, subject to the terms of your signed agreement.

XV. If a conditional sale does not proceed to closing, the deferred sale-completion fee will generally not be payable unless your signed agreement specifically provides otherwise.

XVI. If the property sells after the listing has expired, been cancelled, withdrawn, or terminated, any obligation to pay a deferred sale-completion fee or other compensation will be determined by the holdover, cancellation, termination, and compensation provisions contained in your signed agreement.

XVII. You may request cancellation or withdrawal of your service or listing at any time by sending written notice to support@ListWithEase.ca.

XVIII. Your cancellation or withdrawal request should include your full name, property address, invoice number, date of purchase, and a clear statement that you are requesting cancellation or withdrawal.

XIX. A cancellation or withdrawal is not considered final until we have acknowledged the request in writing and any required cancellation, withdrawal, or termination documents and procedures have been completed.

XX. Cancelling or withdrawing a service or listing does not automatically create an entitlement to a refund. The upfront package fee generally remains non-refundable because it covers reserved service capacity and work that has already been completed, initiated, scheduled, coordinated, or prepared.

XXI. Completing an online payment does not guarantee that your property will be activated or published as an MLS® listing.

XXII. Before a listing can be activated, you may be required to complete all applicable agreements and documents, provide accurate and complete property information, establish ownership or signing authority, and satisfy applicable brokerage, MLS®, professional, legal, and regulatory requirements.

XXIII. If you choose not to sign required agreements, fail to provide required documents or information, provide inaccurate or incomplete information, or otherwise do not satisfy the requirements necessary to proceed with the listing, the upfront package fee will remain non-refundable, subject to applicable law.

XXIV. We may decline, pause, suspend, withdraw, or cancel services where reasonably necessary because of legal, regulatory, brokerage, MLS®, safety, title, property-information, ownership, signing-authority, compliance, or professional-conduct concerns.

XXV. If we decline, pause, suspend, withdraw, or cancel services for one of these reasons, we will explain the applicable reason where appropriate and discuss the available next steps. Any refund, partial refund, credit, or other adjustment will be determined in accordance with applicable law and the terms of your signed agreement.

XXVI. A refund of the upfront package fee may be provided where, after receiving and reviewing the property information reasonably required to assess the listing, ListWithEase determines that it is unable to provide the purchased MLS® listing service solely because of a matter within ListWithEase’s own ability or capacity to provide the purchased service, and the inability to proceed is not caused or contributed to by the homeowner, the property, incomplete or inaccurate information, ownership or title matters, third-party requirements, applicable law, regulatory requirements, brokerage requirements, or MLS® requirements.

XXVII. For greater certainty, a refund under Clause XXVI is intended to apply where ListWithEase, after reviewing the property and required information, determines that it cannot provide the MLS® or REALTOR.ca® listing service that was purchased for reasons attributable solely to ListWithEase and no reasonable alternative or substantially equivalent service can be provided.

XXVIII. A refund will not automatically be payable merely because a property cannot immediately be listed, requires additional information, requires corrections, requires additional documentation, requires owner signatures, requires brokerage review, requires regulatory review, or cannot initially satisfy an applicable MLS®, brokerage, legal, professional, or regulatory requirement.

XXIX. A refund will not be payable where ListWithEase is unable to proceed because of circumstances relating to the homeowner or property, including incomplete, inaccurate, misleading, inconsistent, or missing information; inability to verify ownership or signing authority; unresolved title or ownership issues; missing signatures or consents; property disclosure concerns; legal or regulatory restrictions; MLS® eligibility or compliance requirements; failure to provide requested documents; failure to cooperate with the listing process; or any other requirement that must reasonably be satisfied before the property can be listed.

XXX. A refund will not be payable where the homeowner provides information that is materially inaccurate, incomplete, misleading, outdated, or different from the actual circumstances of the property and that information prevents or materially delays ListWithEase from proceeding with the service.

XXXI. A refund will not be payable where one or more registered owners, spouses, trustees, attorneys, estate representatives, corporate signing authorities, or other persons whose authorization or consent is reasonably required refuse or fail to sign required documents or participate in the listing process.

XXXII. A refund will not be payable where ListWithEase declines, suspends, or discontinues the service because proceeding would reasonably place ListWithEase, its brokerage, its real estate professionals, or its service providers in breach of applicable law, professional obligations, brokerage policies, MLS® rules, regulatory requirements, or other mandatory requirements.

XXXIII. Where the conditions for a refund under Clause XXVI are satisfied, the refund will apply to the eligible upfront package fee actually paid, subject to applicable law and any non-refundable third-party charges or services that the homeowner separately authorized and that have already been booked, provided, incurred, or completed, where deduction of those amounts is permitted by law and the applicable agreement.

XXXIV. Some packages may include or allow you to purchase optional add-ons or third-party services, including professional photography, RMS measurements, floor plans, drone photography or video, virtual tours, staging, advertising, marketing services, lockbox services, or other services supplied by independent providers.

XXXV. Fees relating to completed third-party services are non-refundable.

XXXVI. Once a third-party service has been scheduled, booked, dispatched, commenced, or performed, cancellation, travel, rescheduling, rebooking, or other applicable charges may apply where disclosed and permitted by law.

XXXVII. Where a refund is otherwise approved, third-party expenses that have already been incurred on your behalf may be deducted from the refund where permitted by applicable law and the applicable agreement.

XXXVIII. You are responsible for providing reasonable and timely access to the property for scheduled services. Delays, missed appointments, unavailable access, unsuitable property conditions, or other access-related issues may result in rescheduling, cancellation, travel, or rebooking fees where applicable.

XXXIX. ListWithEase does not guarantee any particular sale price, sale timeline, number of showings, number of offers, buyer interest, MLS® approval or publication timing, advertising performance, marketing exposure, or other particular market result.

XL. No refund of the upfront package fee will be provided solely because your property does not sell, receives no offers, receives fewer showings or inquiries than expected, sells for a different amount than expected, or takes longer to sell than anticipated.

XLI. No refund of the upfront package fee will be provided solely because you change your mind, change your marketing strategy, change your asking price, decide to sell privately, decide to use a traditional brokerage or another real estate professional, market conditions change, or you decide to withdraw, suspend, cancel, or allow the listing to expire, subject to applicable law.

XLII. If your property does not sell and no transaction successfully closes, you will not be charged a deferred sale-completion fee, subject to the applicable terms of your signed agreement.

XLIII. This policy applies to package fees, upfront fees, approved add-on charges, and any applicable deferred sale-completion fee. It does not eliminate your responsibility for other expenses that you separately authorize or incur.

XLIV. Separate expenses may include GST, optional add-ons, photography or other third-party services, buyer brokerage compensation where agreed, legal fees, moving costs, repairs, renovations, staging, property preparation expenses, and other seller costs that are not expressly included in your selected package.

XLV. Any buyer brokerage compensation offered or agreed to is separate from the ListWithEase package fee and deferred sale-completion fee unless your signed agreement specifically states otherwise.

XLVI. The fact that an MLS® listing has not yet been activated at the time you request cancellation does not, by itself, create a right to a refund. The upfront package fee compensates ListWithEase for reserving capacity and beginning the service process, which may include consultation, administration, property review, document preparation, data preparation, coordination, compliance review, and listing setup before publication occurs.

XLVII. A request to cancel shortly after making payment does not automatically create a refund entitlement merely because the property has not yet appeared on MLS® or REALTOR.ca®. Any statutory cancellation right that applies under applicable law will continue to apply and is not waived by this policy.

XLVIII. You acknowledge that the upfront package fee is consideration for beginning and providing the package services and is not solely a fee for the eventual publication of the property on MLS® or REALTOR.ca®. Publication itself is not the only service for which the upfront fee is charged.

XLIX. Where ListWithEase is able and willing to provide the purchased listing service in accordance with the selected package and applicable requirements, but you choose not to continue for a reason personal to you or choose another method of selling the property, the upfront package fee remains non-refundable, subject to any statutory right that cannot legally be waived.

L. Any determination that ListWithEase is unable to provide the purchased service and that a refund is therefore available must be confirmed by ListWithEase in writing. A homeowner’s belief, preference, assumption, disagreement, or decision that the service should not proceed does not by itself establish eligibility for a refund.

LI. To request a refund, you must send your request to support@ListWithEase.ca and include your full name, property address, invoice number, payment date, and the reason for your refund request.

LII. Submitting a refund request does not guarantee that a refund will be approved. Each request will be reviewed in accordance with this policy, your signed agreement, the services already completed or initiated, applicable third-party costs, and applicable law.

LIII. Where a refund is approved or required by law, the approved amount will normally be returned to the original payment method within approximately 15 to 20 business days, unless a different timeframe is required by law, the payment provider, or another applicable requirement.

LIV. Processing times after a refund has been issued may also depend on your bank, credit-card company, or payment provider and may be outside the control of ListWithEase.

LV. Nothing in this Refund and Cancellation Policy is intended to waive, restrict, or remove any statutory right or remedy that cannot legally be waived under applicable consumer-protection or other laws.

LVI. Where Alberta law or other applicable law requires a different refund, cancellation, disclosure, or payment outcome than what is stated in this policy, the applicable law will govern.

LVII. Questions regarding payments, cancellations, refunds, upfront package fees, third-party charges, or deferred sale-completion fees may be sent to ListWithEase at support@ListWithEase.ca.
