Terms of Service
-
These Terms of Service apply to your use of ListWithEase.ca and to any inquiry, form submission, package selection, payment, appointment, or service you request through the website. In these Terms, “ListWithEase.ca,” “we,” “us,” and “our” mean the business carrying on business as ListWithEase.ca. “You” and “your” mean the person using the website, purchasing a package, requesting a listing service, submitting property information, or acting for a property owner.
-
These Terms are intended to explain how our website and services work in clear language. They should be read together with the Privacy Policy, Refund and Cancellation Policy, Service Inclusions and Exclusions, Payment Terms, Seller Representation Agreement, Customer Agreement, Disclosure Forms, and any other agreement or document you sign or receive in connection with your service.
-
If there is a conflict between these Terms, a signed service agreement, and applicable law, applicable law will apply first. The signed service agreement will govern the real estate relationship, listing authority, compensation, listing term, buyer brokerage compensation, holdover period, duties, and other matters that it specifically addresses.
-
By using the website, submitting a form, purchasing a package, or asking us to provide services, you confirm that you have read and agree to these Terms. If you do not agree, do not use the website, submit information, or purchase a package.
-
ListWithEase.ca provides an online way for homeowners in Edmonton and surrounding areas to explore flat-fee MLS® listing and related real estate marketing packages. The website may allow you to review package options, pay an upfront fee, provide preliminary property details, request contact from our team, and begin the process of preparing a potential listing.
-
Payment and form submission begin the listing process but do not create an immediate or guaranteed MLS® listing. An MLS® listing can only be prepared and activated after we have reviewed the property information, confirmed that the service is appropriate, received all required documents and signed agreements, completed any required brokerage review, and met applicable professional, legal, regulatory, and MLS® requirements.
-
We may contact you after payment or submission to request additional information, schedule a consultation, explain the next steps, or advise whether we are able to proceed.
-
You must be legally able to enter into a binding agreement in Alberta to use paid services through the website. By submitting information or purchasing a package, you confirm that you are at least the age of majority in your province or territory of residence and that you are the registered owner of the property or are properly authorized to act for the registered owner.
-
If more than one owner, spouse, trustee, attorney, estate representative, corporation, or other person has a legal or beneficial interest in the property, you are responsible for telling us promptly and ensuring that all required parties participate in the listing process and sign required documents.
-
You must not use our website or services to list a property that you do not own or have authority to sell, submit information on behalf of another person without authority, misrepresent ownership, or interfere with another person’s listing agreement or contractual rights. We may ask for reasonable evidence of ownership, authority, identification, or signing authority before providing services.
-
Visiting the website, contacting us, submitting an inquiry, paying an upfront package fee, or receiving general information does not by itself create an agency relationship, customer relationship, seller representation relationship, fiduciary duty, listing agreement, or obligation for us to list your property.
-
Any real estate relationship will be created only when the applicable written agreement has been completed and signed by the required parties. Until that point, information provided through the website may be used to assess your request, communicate with you, and prepare for a possible service, but it does not mean that we have agreed to represent you or that your property is listed.
-
Package descriptions on the website are summaries intended to help you compare available options. The exact services included in your selected package will be confirmed in the package description, invoice, Service Inclusions and Exclusions page, and any signed agreement.
-
Depending on the package you select, services may include listing consultation, collection of seller-supplied property information, listing-data entry, MLS® listing preparation and submission, REALTOR.ca® exposure where available through the applicable MLS® system, administrative support, photography coordination, professional photography, RMS measurements, floor plans, marketing coordination, showing support, or other specifically stated services.
-
Services not specifically listed in the selected package are excluded unless separately agreed in writing. Examples may include legal advice, legal document drafting, home staging, repairs, renovations, moving services, guaranteed sale results, guaranteed listing activation dates, buyer brokerage compensation, and third-party services that have not been purchased or approved.
-
We may update package descriptions, features, prices, availability, and service options from time to time. Changes will not alter the written terms of a package that you have already purchased and that we have accepted unless you agree in writing or a change is required by law, regulation, brokerage policy, or MLS® rules.
-
All prices displayed on the website are in Canadian dollars unless clearly stated otherwise. Applicable GST and any other legally required taxes are additional unless the website clearly states that tax is included.
-
You are responsible for reviewing the selected package, stated upfront amount, any deferred or sale-completion fee, applicable taxes, and optional add-ons before completing payment. The total amount, payment timing, and included services must be clearly stated before payment.
-
Payments are processed by a third-party payment provider. By submitting payment details, you confirm that you are authorized to use the payment method and authorize the payment provider to charge the applicable amount.
-
We may cancel, decline, pause, or reverse a transaction where payment cannot be processed, appears unauthorized, is subject to fraud concerns, or is inconsistent with these Terms or applicable law.
-
We may issue an invoice, receipt, payment confirmation, or transaction record after payment. An online payment confirmation does not mean that we have accepted the property for listing, confirmed a representation relationship, guaranteed MLS® publication, or agreed to provide services that are not included in the selected package.
-
Certain packages require an upfront package fee to begin the listing preparation process. The upfront fee covers the services, reserved capacity, administrative work, setup work, review, coordination, and other package-specific work described in the applicable package and related documents.
-
The upfront package fee is non-refundable once payment has been processed, except where a refund is required by applicable law or expressly stated in a signed agreement or our Refund and Cancellation Policy.
-
Some packages may also include a deferred sale-completion fee, meaning a remaining amount that is payable only if the property sale successfully closes, as set out in the applicable signed service agreement.
-
If your package includes a deferred sale-completion fee, the amount, taxes, due date, definition of closing, and any holdover or post-termination obligations will be stated in the signed agreement. If no sale closes, no deferred sale-completion fee will be charged, subject to the terms of the signed agreement.
-
If a conditional sale fails before closing, the deferred sale-completion fee is not payable unless the signed agreement clearly provides otherwise. The deferred sale-completion fee is not optional; it becomes payable when the agreed closing condition occurs.
-
Buyer brokerage compensation, if offered or agreed, is separate from the flat-fee package and deferred sale-completion fee unless the signed agreement clearly says otherwise. Legal fees, taxes, repairs, staging, third-party services, and other seller costs are also separate unless expressly included in writing.
-
Before a listing can be activated, you may be required to complete a Seller Representation Agreement, Customer Agreement, Consumer Relationship Guide, Listing Data Form, Property Disclosure, Payment Acknowledgement, Privacy Consent, Marketing Authorization, MLS® forms, brokerage documents, and any other documents required by law, regulation, the brokerage, or the applicable MLS® board.
-
You must provide requested information and documents in a timely manner. We may delay, decline, suspend, withdraw, or cancel services if required documents are not completed, ownership or signing authority is unclear, information is incomplete or inaccurate, the property does not meet applicable requirements, or we cannot meet legal, regulatory, professional, brokerage, or MLS® obligations.
-
If you decide not to sign required agreements, do not provide necessary documents, provide inaccurate or incomplete information, or otherwise do not meet listing requirements, the upfront fee remains non-refundable, subject to applicable law.
-
You are responsible for ensuring that all information, materials, documents, instructions, photographs, measurements, floor plans, property descriptions, disclosures, and representations you provide are accurate, complete, current, lawful, and authorized for use.
-
You agree to promptly notify us of any change to the property’s condition, ownership, occupancy, price, availability, defects, renovations, fixtures, inclusions, exclusions, legal status, pending offers, or other material fact that could affect the listing or a buyer’s decision.
-
You confirm that you have authority to provide the information and materials you submit, including images, videos, floor plans, documents, and personal information relating to other people. You are responsible for obtaining any consent required from co-owners, occupants, tenants, condominium corporations, photographers, contractors, or other parties.
-
We may rely on the information you provide unless we have reason to believe it is inaccurate, incomplete, misleading, or unauthorized. We may request clarification, supporting documents, corrections, or updated information.
-
We may edit listing content for clarity, consistency, professionalism, regulatory compliance, MLS® requirements, character limits, or website formatting, but we do not guarantee that every error will be found. You remain responsible for reviewing the final listing information when requested and promptly identifying corrections before or after publication.
-
We do not guarantee that your property will be listed by a specific date, displayed in a particular location, receive a specific number of views, showings, offers, or inquiries, sell within a particular period, sell for a particular price, sell at all, appear in search results, receive marketing exposure beyond what is included in your package, or produce any particular financial result.
-
Real estate markets, buyer behaviour, MLS® systems, search engines, advertising platforms, showing activity, financing conditions, pricing, property condition, competition, and other factors may affect the sale of a property.
-
We do not guarantee the availability, timing, operation, indexing, accuracy, display, or continued publication of any MLS® system, REALTOR.ca®, third-party website, advertising platform, payment provider, social-media service, search engine, or technology provider.
-
Any examples, estimates, testimonials, or general information on the website are provided for general information only and are not promises or guarantees of future results.
-
Where your service includes MLS® listing preparation or submission, listing information may be submitted to the applicable MLS® board and may be displayed on REALTOR.ca® and other participating websites, subject to applicable rules and approvals.
-
Public listing information may include the property address, property features, photographs, videos, floor plans, room dimensions, listing price, showing instructions, descriptions, and other information required or permitted for marketing.
-
Once information is published publicly, it may be copied, saved, indexed, cached, shared, screenshot, archived, or republished by third parties. We cannot guarantee immediate removal from every third-party platform, search result, cache, archive, social-media post, email, or database.
-
Some packages may include or allow you to purchase services supplied by independent third parties, including photographers, videographers, drone operators, RMS measurement providers, floor-plan providers, virtual-tour providers, staging providers, lockbox providers, marketing providers, and showing-service providers.
-
Availability, timing, quality, weather, property access, safety conditions, and third-party scheduling may affect these services. You are responsible for providing safe and timely access to the property and securing valuables, confidential documents, medication, weapons, pets, and other personal items before appointments.
-
We and third-party providers may decline or reschedule services where conditions are unsafe, access is unavailable, weather is unsuitable, the property is not reasonably ready, or another valid reason prevents completion of the service.
-
Completed third-party services are non-refundable. Once a third-party service has been booked, dispatched, or performed, cancellation, travel, rescheduling, or rebooking charges may apply where disclosed and permitted by law.
-
Measurements, photographs, floor plans, virtual tours, and similar materials may be subject to limitations, assumptions, industry standards, and third-party terms and should not be treated as legal, engineering, survey, appraisal, inspection, zoning, title, or property-condition advice.
-
Unless expressly included in your selected package and confirmed in writing, you are responsible for property access, showing preparation, communication with prospective buyers, and other seller responsibilities.
-
Showing support, showing requests, feedback coordination, lockbox coordination, offer-management support, or negotiation-related services will be provided only to the extent stated in your package or signed agreement.
-
You remain responsible for making decisions about price, offers, counteroffers, possession, inclusions, conditions, and whether to accept or reject an offer, subject to any advice and services provided under a signed real estate agreement.
-
We do not provide legal advice. You should obtain independent legal advice regarding contracts, title, estate matters, family-property issues, tenancy, tax, disclosure obligations, title defects, financing, or other matters outside the scope of the real estate services agreed to in writing.
-
You may request cancellation or withdrawal of a service or listing by sending written notice to support@listwithease.ca with your full name, property address, invoice number, date of purchase, and a clear request.
-
A cancellation or withdrawal request is not final until we acknowledge it in writing and any required termination documents have been completed.
-
Cancelling or withdrawing a listing does not automatically create a refund. The Refund and Cancellation Policy applies to upfront fees, third-party services, refunds, and deferred sale-completion fees.
-
Your signed service agreement may also contain terms regarding cancellation, expiry, withdrawal, termination, holdover periods, and compensation. Those terms continue to apply where legally enforceable.
-
Nothing in these Terms is intended to limit any cancellation or refund right you have under applicable law.
-
Our collection, use, disclosure, storage, and protection of personal information are explained in our Privacy Policy.
-
By providing your contact information, you agree that we may contact you by telephone, email, text message, or another reasonable method regarding your inquiry, payment, account, appointment, listing, property information, required documents, service updates, security matters, legal notices, and other service-related matters.
-
Promotional communications will only be sent where permitted by law. You may unsubscribe from promotional email messages using the unsubscribe option in the message or by contacting us.
-
Opting out of promotional communications does not prevent us from sending necessary transaction, service, payment, legal, regulatory, security, or listing-related communications.
-
You may use the website only for lawful personal or business purposes connected with evaluating or requesting our services.
-
You must not submit false, misleading, defamatory, discriminatory, unlawful, infringing, harmful, or unauthorized content or interfere with website security, attempt unauthorized access, introduce viruses or malicious code, scrape or copy website content at scale, impersonate another person, misuse payment systems, or interfere with our systems or other users.
-
We may restrict, suspend, or terminate access to the website where we reasonably believe these Terms have been breached or where necessary to protect our business, clients, systems, or the public.
-
The website design, text, graphics, branding, logos, package descriptions, photographs that we own or are licensed to use, content, layout, software, and other materials are owned by or licensed to us and are protected by applicable intellectual-property laws.
-
You may view and print website content for personal use while considering our services but may not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from, or commercially use website content without written permission, except where permitted by law.
-
You retain ownership of content you provide to us, but you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, store, display, distribute, publish, and share that content as reasonably necessary to provide your requested services, market the property, meet legal and professional obligations, and administer our business.
-
The licence to use your content ends when the content is no longer needed, except where we are required or permitted to retain records or previously published materials because of law, agreements, technical limitations, archives, backups, regulatory requirements, or legitimate legal purposes.
-
The website may link to or integrate with third-party services, including Wix, Stripe, payment providers, MLS® boards, REALTOR.ca®, social-media platforms, analytics providers, electronic-signature services, email providers, photographers, and other service providers.
-
Third-party providers operate independently and have their own terms, privacy policies, availability, security measures, and practices. We do not control and are not responsible for third-party websites, platforms, content, services, outages, privacy practices, payment processing, or policies.
-
We will provide services with reasonable care and in accordance with applicable law and the signed agreement. However, to the fullest extent permitted by law, we are not responsible for losses, delays, errors, outages, failed communications, technical issues, third-party acts or omissions, market conditions, buyer decisions, seller decisions, property conditions, title issues, legal issues, financing failures, inspection results, MLS® system issues, search-engine results, advertising-platform decisions, or circumstances outside our reasonable control.
-
Nothing in these Terms excludes liability that cannot legally be excluded or limits rights you may have under applicable consumer-protection, privacy, or real-estate law.
-
You are responsible for losses, claims, costs, or expenses resulting from information, materials, instructions, representations, or conduct you provide or authorize that are false, inaccurate, incomplete, misleading, unlawful, infringing, or unauthorized, to the extent permitted by law.
-
This may include claims involving property descriptions, photographs, ownership authority, privacy rights, copyright, tenant rights, undisclosed material facts, property access, or directions you provide to us.
-
If a claim is made against us because of your breach of these Terms or a signed agreement, you agree to reasonably cooperate in responding to the claim and to be responsible for amounts you are legally required to pay.
-
This responsibility does not apply to the extent a claim results from our own negligence, misconduct, or failure to meet a legal duty that cannot be waived.
-
We may update these Terms from time to time to reflect changes in our website, services, legal obligations, technology, business practices, or package offerings.
-
The current version will be posted on the website with a revised effective date. Changes will apply to future website use and future purchases after posting.
-
Changes will not alter an existing signed service agreement unless agreed to in writing or required by law. Where applicable law requires consent to a material change, we will seek that consent appropriately.
-
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta.
-
Before starting a formal legal proceeding regarding these Terms or the website, you agree to first contact us at support@listwithease.ca and provide a reasonable opportunity for us to review and attempt to resolve the concern in good faith.
-
This requirement does not prevent you from exercising any right that cannot be restricted by private agreement, including making a complaint to a privacy regulator, real estate regulator, consumer-protection authority, or other government body.
-
If any part of these Terms is found to be invalid, illegal, or unenforceable, that part will be limited or removed only to the extent necessary, and the remaining Terms will continue to apply.
-
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
-
Questions regarding these Terms, your package, payment, cancellation, or the listing process may be sent to ListWithEase.ca at support@listwithease.ca.
LISTING POLICY
I. Users of ListWithEase.ca agree to comply with this Listing Policy, the Terms of Service, applicable MLS® rules, brokerage requirements, and applicable law. ListWithEase may remove, edit, reject, suspend, or restrict content or services that violate these requirements or are otherwise inappropriate or unsuitable for publication.
II. Property listings must be submitted by the registered property owner or by a person who has lawful authority to act on behalf of the owner. ListWithEase may request documentation to verify ownership, identity, or authority before publishing or continuing a listing.
III. REALTORS®, agents, representatives, builders, developers, or other persons submitting a property on behalf of an owner must have proper authority and instructions to do so and may be required to provide supporting documentation.
IV. All property information must be accurate, complete, current, and not misleading. You must not exaggerate, falsify, conceal, or knowingly misrepresent property details. If you are unsure about a material fact, do not present it as confirmed.
V. You are responsible for promptly advising ListWithEase of any material change or error concerning the property, including price, condition, measurements, ownership, occupancy, renovations, permits, inclusions, exclusions, or other information that may affect a buyer's decision.
VI. ListWithEase may request supporting documents or clarification and may edit, remove, correct, or decline to publish information that appears inaccurate, misleading, unlawful, discriminatory, unauthorized, inconsistent with MLS® rules, or contrary to professional or brokerage requirements.
VII. Unless expressly offered under the selected package, ListWithEase listing services are intended for properties offered for sale. Rental-only properties, short-term rentals, vacation rentals, timeshares, fractional ownership arrangements, or other unsupported property types may not be submitted through a sale-listing package.
VIII. Hyperlinks, website addresses, QR codes, social-media links, or other external links may be removed where prohibited by MLS®, brokerage, advertising, or ListWithEase requirements.
IX. Listing descriptions and photographs must not contain unauthorized self-promotional information, including names, phone numbers, email addresses, website addresses, logos, promotional slogans, advertisements, or other marketing information where prohibited by applicable MLS® or brokerage rules.
X. Photographs, videos, floor plans, descriptions, and other materials must be lawfully owned or authorized for use. You must not submit content copied from another REALTOR®, brokerage, photographer, builder, website, or third party without permission.
XI. Photographs, virtual staging, edited images, renderings, or marketing materials must not materially misrepresent the property's actual condition or features. ListWithEase may remove or require correction of any content that could reasonably mislead buyers.
XII. You may not instruct ListWithEase to publish false information, conceal a material fact, make discriminatory statements, misrepresent permits or legal status, or publish content that would violate applicable law, MLS® rules, brokerage requirements, or professional obligations.
XIII. Payment for a package does not guarantee publication of content that ListWithEase reasonably determines cannot lawfully, accurately, professionally, or appropriately be published.
XIV. ListWithEase may delay, reject, suspend, edit, withdraw, or cancel a listing where required information is missing, ownership or authority cannot be verified, submitted information is misleading or inaccurate, or the listing cannot meet applicable MLS®, brokerage, regulatory, professional, or legal requirements.
XV. A decision by ListWithEase to correct, reject, remove, or decline content for compliance, accuracy, professional, brokerage, MLS®, or legal reasons does not by itself create a right to a refund. Refund eligibility is determined under the Refund and Cancellation Policy, any signed agreement, and applicable law.
XVI. You remain responsible for reviewing your listing information and promptly reporting any errors or required changes before or after publication.
XVII. ListWithEase retains reasonable discretion, subject to applicable law and signed agreements, to determine whether submitted content is suitable for publication, whether additional verification is required, and whether a listing can be activated or continued.
XVIII. This Listing Policy forms part of the ListWithEase Terms of Service and should be read together with the Privacy Policy, Refund and Cancellation Policy, applicable package terms, and any signed service or representation agreement.
