Privacy Policy
I. This Privacy Policy explains how ListWithEase.ca (“ListWithEase,” “we,” “us,” and “our”) collects, uses, shares, stores, and protects personal information when you visit our website, contact us, submit a form, purchase a package, provide property information, or use our services.
II. This Privacy Policy should be read together with our Terms of Service, Refund and Cancellation Policy, applicable package terms, and any signed service or representation agreement. If there is a conflict, applicable law will govern first, followed by the applicable signed agreement to the extent permitted by law.
III. We collect only personal information that is reasonably necessary to provide our services, operate our website, process payments, communicate with you, prepare and manage listings, meet professional and legal obligations, prevent fraud, and protect our business and customers.
IV. Personal information we collect may include your name, email address, phone number, mailing address, property address, ownership information, property details, listing instructions, photographs, floor plans, measurements, documents, communications, payment-related records, and other information reasonably required to provide the requested service.
V. When you make a payment, your payment information may be processed by a third-party payment provider. ListWithEase does not intentionally store your complete credit-card or debit-card number on its own systems. We may retain transaction details such as payment amount, date, invoice number, payment status, refund information, or chargeback information.
VI. We may also collect limited technical information when you use our website, including your IP address, browser type, device type, pages viewed, referring website, approximate location, cookies, and similar usage information. This information may be used to operate, secure, improve, and understand the performance of our website and marketing.
VII. You are responsible for ensuring that the information, documents, photographs, property descriptions, measurements, instructions, and other materials you provide are accurate, complete, current, lawful, and authorized for use.
VIII. If you provide personal information about another person, including a co-owner, spouse, tenant, occupant, representative, or other individual, you are responsible for ensuring that you have any authority or consent reasonably required to provide that information.
IX. We may request identification, ownership documents, signatures, authorizations, or other supporting information where reasonably necessary to verify identity, ownership, authority, or the accuracy of submitted information.
X. ListWithEase may delay, decline, suspend, correct, or remove information where it appears inaccurate, incomplete, misleading, unauthorized, unlawful, inconsistent with MLS® requirements, or contrary to brokerage, professional, or regulatory obligations.
XI. We may use personal information to respond to inquiries, contact you, process payments, prepare documents, review property information, coordinate photography or measurements, prepare and manage MLS® listings, communicate showing or listing information, provide customer support, maintain records, prevent fraud, respond to complaints, and administer our services.
XII. We may also use personal information where reasonably necessary to meet legal, tax, accounting, insurance, brokerage, MLS®, regulatory, audit, security, or professional obligations.
XIII. Real estate marketing may require some property information to become public. Where your property is listed or marketed, information such as the property address, listing price, photographs, videos, floor plans, measurements, property features, descriptions, showing information, and listing status may be distributed through an MLS® system, REALTOR.ca®, participating real estate websites, social-media platforms, marketing channels, and other authorized services.
XIV. Once property information has been publicly distributed, third parties may copy, save, screenshot, index, cache, archive, share, or republish it. Although we may take reasonable steps to update or remove information where appropriate, we cannot guarantee removal from every third-party website, search result, archive, cache, database, screenshot, or other independent system.
XV. Buyer and prospective buyer information will not be made publicly available merely because a person makes an inquiry. However, relevant buyer information may be shared with the seller, applicable brokerage, real estate professionals, showing-service providers, legal advisers, or other parties where reasonably necessary to arrange showings, respond to inquiries, administer offers, complete transactions, or comply with legal or professional requirements.
XVI. We may share personal information with service providers that assist us in operating our business, including website providers, payment processors, electronic-signature services, cloud-storage providers, CRM systems, email or telephone providers, photographers, videographers, RMS measurement providers, floor-plan providers, marketing providers, showing-service providers, accountants, insurers, lawyers, and technology providers.
XVII. Third-party service providers may operate under their own privacy policies, security practices, and legal obligations. ListWithEase is not responsible for independent third-party activities outside our custody or control, subject to any responsibility imposed on us by applicable law.
XVIII. Some service providers may process or store information outside Alberta or outside Canada. Information processed in another jurisdiction may be subject to the laws of that jurisdiction and may be accessible to courts, regulators, or government authorities where permitted by law.
XIX. Our website may use cookies, analytics tools, advertising technologies, and similar technologies to operate the website, maintain security, understand website traffic, improve our services, and measure advertising performance. You may manage cookies through your browser or available website settings, but disabling certain technologies may affect website functionality.
XX. We may contact you by email, telephone, text message, or another reasonable method regarding your inquiry, payment, appointment, listing, required documents, property information, service updates, security matters, legal notices, or other service-related matters.
XXI. Promotional communications will only be sent where permitted by law. You may unsubscribe from promotional messages, but opting out of marketing communications does not prevent us from sending necessary service, payment, listing, security, legal, or regulatory communications.
XXII. We use reasonable administrative, technical, and physical safeguards appropriate to the nature and sensitivity of the information we hold. However, no website, email system, cloud platform, payment system, device, or internet transmission can be guaranteed to be completely secure.
XXIII. If we become aware of a privacy or security incident involving personal information under our control, we may investigate the matter, take reasonable steps to contain or address it, and notify affected individuals, regulators, or other parties where required by applicable law.
XXIV. We retain personal information for as long as reasonably necessary to provide services, administer listings and transactions, respond to questions, maintain business records, meet brokerage, MLS®, tax, accounting, insurance, regulatory, or legal obligations, prevent fraud, address disputes, or establish and defend legal rights.
XXV. Cancelling a listing, ending a service, changing service providers, or withdrawing consent does not automatically require immediate deletion of all personal information. Information may continue to be retained where required or permitted by law, professional obligations, brokerage requirements, MLS® requirements, accounting rules, insurance requirements, dispute resolution, fraud prevention, or legitimate legal purposes.
XXVI. Subject to applicable law, you may request access to personal information we hold about you or ask us to correct information that is inaccurate or incomplete. We may require reasonable identification before responding to a request.
XXVII. Access may be limited or refused where permitted by law, including where disclosure would reveal another person's personal information, compromise security, interfere with an investigation, reveal privileged information, or conflict with another legal or regulatory obligation.
XXVIII. You may withdraw consent to certain future uses or disclosures of personal information, subject to legal, contractual, regulatory, professional, and operational restrictions. If the information is reasonably necessary to provide or continue an MLS® listing or other service, withdrawal of consent may prevent us from continuing that service.
XXIX. Withdrawal of consent does not create an automatic right to a refund. Any payment, cancellation, termination, or refund consequences will be determined under our Refund and Cancellation Policy, applicable signed agreements, and applicable law.
XXX. A homeowner cannot require ListWithEase to maintain an active public listing while preventing the use or disclosure of property information reasonably necessary to operate, distribute, or market that listing.
XXXI. ListWithEase retains reasonable discretion, subject to applicable law and signed agreements, to determine what information is reasonably required, whether additional verification is necessary, whether information may be published, whether information should be corrected or removed, and whether a requested service can continue.
XXXII. A homeowner’s disagreement with a reasonable privacy, compliance, verification, security, or publication decision made by ListWithEase does not by itself establish a privacy violation, contractual breach, or right to a refund.
XXXIII. Nothing in this Privacy Policy allows ListWithEase to override a statutory privacy right, regulatory order, court order, mandatory professional obligation, or other legal requirement that cannot lawfully be excluded.
XXXIV. We may update this Privacy Policy from time to time to reflect changes in our services, website, technology, service providers, legal obligations, or business practices. The current version will be posted on ListWithEase.ca with an updated effective date.
XXXV. Where applicable law requires additional notice or consent for a material change, we will provide that notice or obtain that consent as required.
XXXVI. Questions, access requests, correction requests, withdrawal-of-consent requests, or privacy concerns may be directed to ListWithEase at support@ListWithEase.ca.
XXXVII. Nothing in this Privacy Policy limits an individual’s right to contact an applicable privacy regulator, court, or other authority where that right is provided by law.
XXXVIII. If any provision of this Privacy Policy is found to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply to the fullest extent permitted by law.
